Arab Bank Files Petition for Writ of Mandamus

On August 29, 2013 Arab Bank filed a Petition for a Writ of Mandamus with the Second Circuit Court of Appeals in Linde v. Arab Bank, PLC. The writ petitions the Second Circuit to vacate the Eastern District Court of New York’s order denying the Bank’s motion for summary judgment on plaintiffs’ Anti-Terrorism Act (ATA) claims based on an erroneous causation standard; the order consolidating hundreds of claims involving dozens of alleged terrorist incidents over three and a half years in one trial; and orders excluding evidence proving the Bank’s compliance with governing laws.
